Annexation Applications

To Annex or Not to Annex?
The following information has been compiled in order to make an easy comparison of the benefits of being annexed into the City versus remaining in unincorporated Gwinnett County. The tables include such information as estimated taxes, sanitation services, average police response times, etc. Comparison 1 is designed for a property with an assessed value of $150,000 while Comparison 2 is for a property with an assessed value of $200,000.

Unless initiated by the Mayor and Council, an application to annex into the corporate boundaries of the City of Snellville must be submitted by the owner(s) of the subject property.  In addition, the property owner(s) must also file a separate Land Use Plan Amendment Application and Zoning Map Amendment Application, both of which must be filed concurrently with the annexation application.

Submittal Deadline:  Noon, 42-Days prior to Planning Commission meeting date.  This is the last day to submit, earlier submittals are encouraged to ensure application acceptance. Planning Commission and Mayor and Council Public Hearing Calendar:
2008 Calendar (Please note these dates are subject to change due to holidays)

Application Procedures:
Once the applications are filed, the Planning Department reviews the applications and prepares a Staff Analysis on the Land Use Plan and Zoning Map Amendment applications, including a recommendation for approval or denial of the applications.  The Staff Analysis is forwarded to members of the Planning Commission, Mayor and City Council, and placed on the website for public view. The Planning Commission then holds a public hearing to review and consider the Land Use Plan and Zoning Map Amendment applications, making a recommendation for approval or denial of the applications to the Mayor and City Council.  Finally, a Public Hearing is held by the Mayor and City Council for final action (approval or denial) on the annexation application, followed by final action on the Land Use Plan and Zoning Map Amendment applications.

Notice Requirements:
The applicant is responsible for notifying ALL
adjoining property owners of the proposed change in Zoning District and/or proposed change in Land Use Plan and give notice of the Planning Commission meeting and again for the subsequent Mayor and Council Public Hearing, including notice of the petition for annexation.  These notices must be postmarked and sent a minimum of 15-days prior to the Planning Commission meeting and Mayor and City Council Public Hearing the U.S. Postal Service via Certified Mail with Return Receipt (proof of delivery). 

Proof of mailing and delivery must be received by the City's Planning Department, along with a parcel map indicating adjoining property owners notified, as well as, a list (containing tax parcel number, name and address of property owner) produced by the Gwinnett County Tax Assessors Office of corresponding adjoining property owners, by close of business Thursday, prior to the Planning Commission meeting and again, Thursday, prior to the Mayor and City Council Public Hearing.  A duplicate mailing with Certificate of Mailing from the U.S. Postal Service is required for any adjoining property owner that has not returned a Return Receipt (proof of delivery).  

Public Notice Sign Requirements:
In addition, the applicant is responsible for placing Public Notice Signs on each parcel subject to the annexation application.  These signs must be erected a minimum of 15-days prior to the Mayor & Council Public Hearing, and placed on each subject parcel having public road frontage.  Parcels with more than one road frontage will require additional signage.  These signs may be obtained from the City's Planning Department and require the applicant to complete the signs with all approriate information.  The applicant is responsible to ensure that the signs remain erect and in ledgible condition throughout the public notice period (beginning 15-days prior to the Mayor and Council public hearing and until final action by the Mayor and City Council at the public hearing).  The applicant is responsible for amending these signs should the Mayor and City Council public hearing date change.  Finally, the applicant shall remove and collect all public notice signs (and properly dispose) within 72-hours following the public hearing.

** Planning Commission meetings and Mayor and Council Public Hearings are held at 7:30 p.m. at Snellville City Hall Council Chambers, 2342 Oak Road, Snellville, unless alternative meeting dates, times, and/or places are necessary.

ANNEXATION OR DE-ANNEXATION BECOMES EFFECTIVE ON THE FIRST DAY OF THE MONTH FOLLOWING THE MONTH DURING WHICH ALL THE APPLICABLE ANNEXATION REQUIREMENTS WERE MET.

The applicant may withdraw an application without prejudice until such time as the legal notice for the Council public hearing is sent to the paper (no less that 21 days before the hearing date). No application shall be allowed to be withdrawn less that 21 days before the Council public hearing unless the request for withdrawal is granted by Council at the public hearing.

If an application is denied, no application affecting any portion of the same property shall be submitted less than twelve (12) months from the date of denial.
